Terms of Use for MCPHERE
These Terms govern your access to and use of MCPHERE, including public registry pages, authenticated product features, watchlists, alerts, comparisons, submissions, sponsor placements, billing flows, APIs, and related communications.
1. Acceptance and eligibility
By accessing or using MCPHERE, you agree to these Terms. If you use the service for an organization, you represent that you have authority to bind that organization. You may not use the service if doing so would violate applicable law or a valid contractual restriction.
2. Accounts and credentials
You are responsible for maintaining the confidentiality of account credentials and for activity carried out through your account or session. MCPHERE may require authentication, verification, or additional security steps for certain features or risk conditions.
3. Acceptable use
You may not use MCPHERE to abuse, overload, scrape in violation of policy, circumvent access controls, interfere with service integrity, probe security, submit unlawful or misleading content, or use the service in a way that harms users, providers, or infrastructure. We may suspend or restrict access to protect the platform or enforce these Terms.
4. Registry, scores, and informational outputs
MCPHERE provides informational, editorial, and technical intelligence outputs, including rankings, scores, health indicators, trend labels, summaries, and comparisons. These outputs support research and operational evaluation but do not constitute legal, investment, security, or professional advice. Sponsorship does not change ranking or scoring logic.
5. User submissions and sponsor content
If you submit a server, sponsor application, description, webhook, or other content, you represent that you have the right to provide it and that it is not unlawful, deceptive, or infringing. MCPHERE may review, reject, edit, remove, or decline to publish submissions or sponsor placements.
6. Paid features and billing
Paid plans, sponsor placements, and related commercial features may be subject to pricing, approval, availability, usage limits, renewals, and payment provider terms shown in the product, on an order form, or in billing communications. Unless expressly stated otherwise, fees are non-refundable to the maximum extent permitted by law.
7. Intellectual property
MCPHERE and its design, software, data presentation, content structure, and non-public materials are protected by applicable intellectual property laws. These Terms do not transfer ownership of MCPHERE intellectual property to you. Repository and third-party source materials remain subject to their own licenses and terms.
8. Third-party services
The service may integrate with or link to third-party platforms such as GitHub, Stripe, Supabase, email providers, analytics services, CAPTCHA providers, or external sites. MCPHERE is not responsible for third-party services, content, availability, or terms.
9. Disclaimers
To the maximum extent permitted by law, MCPHERE is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation.
10. Limitation of liability
To the maximum extent permitted by law, MCPHERE and its operators, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business opportunities arising from or related to the service. Where liability cannot be excluded, it is limited to the amount paid by you to MCPHERE for the relevant paid feature in the 12 months preceding the event giving rise to the claim.
11. Indemnity
You agree, to the extent permitted by law, to indemnify and hold harmless MCPHERE and its operators against claims, liabilities, losses, and expenses arising from your misuse of the service, your submitted content, or your violation of these Terms or applicable law.
12. Suspension, termination, and changes
MCPHERE may suspend, restrict, modify, or discontinue parts of the service at any time, including to maintain security, legal compliance, or operational stability. We may also update these Terms from time to time. Continued use after updated Terms take effect means you accept the revised version.
13. Governing law
Unless otherwise stated in an applicable commercial agreement, these Terms are governed by the laws of the jurisdiction in which the MCPHERE operator is established, excluding conflict-of-law rules, and disputes shall be brought in the courts or dispute forum permitted by that jurisdiction, except where mandatory consumer law provides otherwise.
